A CVV is a 3 or 4 digit code printed on a payment card. Visa, Mastercard, and Discover use 3 digits on the back. American Express uses 4 digits on the front. The code confirms that the person entering the card number holds the physical card.
Sellers who list cheap CVV data sell account numbers, expiration dates, and security codes taken from other people's accounts. The trade is theft of an access device. There is no licensed vendor, no warranty, and no recourse for a buyer.
18 U.S.C. 1029 covers fraud and related activity in connection with access devices. It makes it a crime to traffic in a card number or CVV not issued to you, to use one, or to possess 15 or more with intent to defraud. Penalties reach 10 years for some counts and 15 years for others, plus fines. 18 U.S.C. 1028 covers identity theft and identity documents.
State statutes add charges. Prosecutors file under federal and state law in the same case.
PCI DSS Requirement 3.2 prohibits storage of sensitive authentication data, including the CVV, after authorization. A merchant that keeps CVV data loses the ability to process cards. This rule is why a card number alone cannot complete most online orders.
Reports to IC3 feed into federal access device investigations. A report also creates a record that supports a dispute with the issuer.
